Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and TRADEINTEL (Pty) Ltd (registration no. 2026/445160/07), a company based in South Africa ("drawguard.io", "we", "us"), governing your use of the drawguard.io website, dashboard, and Expert Advisor (together, the "Service"). By creating an account or using the Service you agree to these Terms.

1. What drawguard.io is — and is not

drawguard.io is a read-only trading risk-analytics tool. It collects account snapshots from your MetaTrader terminal and displays drawdown, equity, and exposure analytics by period, symbol, and strategy.

drawguard.io is not financial, investment, or trading advice. We do not provide trading signals, recommendations, portfolio management, money transfer, or any regulated financial service. We never place trades and never hold or transfer your funds. Nothing in the Service is a recommendation to make any trade or financial decision. Trading is high-risk and you are solely responsible for your own decisions. Past performance does not guarantee future results.

2. Eligibility & accounts

You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of your account information and for keeping your credentials secure. You are responsible for all activity under your account.

3. The EA and your data

You authorise the EA you install to read account state and trade history from your terminal and transmit it to the Service so we can provide analytics. You confirm you have the right to connect any trading account you add. Our handling of your data is described in the Privacy Policy.

4. Acceptable use

You agree not to: misuse, disrupt, reverse-engineer, or attempt to gain unauthorised access to the Service; resell or redistribute the Service without permission; upload unlawful content; or use the Service to violate any law or third-party right (including your broker's or prop firm's terms).

5. Accuracy & limitations

We work hard on data accuracy, but the Service is provided for informational purposes and may contain gaps or errors, including: data gaps while the EA is offline; withdrawals that may appear as equity drops; symbol-filter views that are illustrative and not true historical backtests; and timezone/attribution differences between your broker and our calculations. You should not rely on the Service as your sole source of truth for compliance with any prop-firm or broker rule.

6. Plans, fees & payments

The Service may be offered on free and paid plans. Payments are processed by our third-party Merchant of Record; your purchase is also subject to the Merchant of Record's buyer terms. Fees, billing frequency, and plan features are shown at checkout. We may change pricing on a prospective basis with notice.

7. Refunds & cancellation

Refunds and cancellations are governed by our Refund Policy.

8. Intellectual property

The Service, including software, design, and content (excluding your data), is owned by TRADEINTEL (Pty) Ltd and licensed to you for use under these Terms. Your trading data remains yours.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that analytics will be complete or accurate.

10. Limitation of liability

To the maximum extent permitted by law, drawguard.io and its founders will not be liable for any indirect, incidental, or consequential damages, or for any trading, investment, or financial losses, loss of profits, account breaches/failed challenges, or data loss arising from your use of the Service. Our total aggregate liability is limited to the amounts you paid us in the 12 months before the claim (or, if you are on a free plan, a nominal amount).

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms or to protect the Service.

12. Changes to the Terms

We may update these Terms; material changes will be posted with a new effective date. Continued use after changes means you accept them.

13. Governing law

These Terms are governed by the laws of the Republic of South Africa, and the courts of South Africa have exclusive jurisdiction, without prejudice to mandatory consumer rights in your country of residence.
